Terms of Service

These Terms of Service (“Terms”) govern your use of the Executive Tennis website and services (“Executive Tennis,” “we,” “us,” “our”). By booking, purchasing, or participating in any Executive Tennis service, you agree to these Terms.

1) Who We Are

Executive Tennis provides tennis coaching, training sessions, and concierge scheduling assistance (including court coordination and optional partner matching) primarily in the greater Indianapolis area, including Indianapolis, Carmel, Fishers, and nearby communities.

2) Eligibility

You must be at least 18 years old to book services for yourself. Minors may participate only if a parent/legal guardian purchases the service and signs any required waiver forms.

3) Services

Executive Tennis may offer, including but not limited to:

Private or semi-private tennis coaching

Match-play coaching and strategy sessions

Concierge scheduling assistance (help coordinating courts and times)

Optional curated match partner introductions (where available)

Important: We do not own or operate third-party tennis facilities. Court availability, facility rules, and access requirements are controlled by the facility.

4) Booking, Scheduling, and Communication

Sessions are scheduled by appointment.

You are responsible for providing accurate contact and scheduling information.

We may communicate via text, email, phone, or messaging apps to coordinate sessions.

If you arrive late, your session may still end at the originally scheduled time to respect subsequent bookings.

5) Payments

Payment is due in advance unless otherwise agreed in writing.

Prices, packages, and program terms will be shown at checkout or in your written agreement/invoice.

You authorize us (and our payment processor) to charge your selected payment method.

If a payment fails, we may pause services until the balance is paid.

6) Packages, Programs, and Expiration

If you purchase a package or multi-week program (e.g., a 4-week concierge program), your package/program:

Is intended to be used within the stated program window.

May have an expiration date disclosed at purchase.

Reasonable flexibility: We understand travel and executive schedules. We may extend a window at our discretion for illness, weather cancellations, or travel especially when communicated early. Any guaranteed extensions must be in writing.

7) Cancellation and Rescheduling Policy

Unless your checkout page or written agreement states otherwise, the following applies:

Client-initiated reschedule/cancel:

More than 24 hours notice: no fee; we reschedule.

Less than 24 hours notice: session is forfeited or charged in full.

No-shows: session is forfeited or charged in full.

Weather and unsafe conditions:

We may reschedule for rain, extreme heat/cold, lightning, poor air quality, unsafe courts, or other safety reasons.

If indoor courts are available and you approve any added facility fees, we can attempt an indoor alternative.

Our reschedule/cancel:

If we must cancel, you will receive a make-up session or credit.

8) Refund Policy

Unless required by law or stated otherwise at purchase:

Single sessions: refundable if canceled more than 24 hours in advance.

Packages/programs: generally non-refundable once started. If you have not started, we may offer a partial refund minus any processing fees and any reserved time already scheduled/held.

If you believe you were charged in error, contact us at [email protected] within 7 days of the charge.

9) Court Fees, Memberships, and Third-Party Costs

Some facilities require membership, guest fees, court fees, or reservation fees. Unless explicitly included in your purchase:

You are responsible for all third-party facility fees.

Any facility rules (attire, cancellations, conduct) are your responsibility to follow.

If we advance facility fees on your behalf, you agree to reimburse us promptly.

10) Match Partner Introductions (Optional)

If we introduce you to potential match partners:

Introductions are offered as a convenience, not a guarantee of availability, compatibility, or skill level.

You are responsible for your interactions, communications, and conduct.

We may discontinue introductions at any time for safety, conduct, scheduling, or business reasons.

11) Participant Responsibilities

You agree to:

Follow coaching instructions and facility rules.

Use appropriate equipment (athletic shoes, racquet, hydration, etc.).

Treat coaches, partners, and facility staff respectfully.

Not engage in harassment, discrimination, unsafe play, intoxication, or disruptive behavior.

We may refuse or terminate service for unsafe or inappropriate conduct, with no obligation to refund.

12) Health, Medical Disclaimer, and Assumption of Risk

Tennis and athletic training involve inherent risks, including but not limited to sprains, strains, falls, collisions, heat illness, cardiac events, and other injuries.

You represent that:

You are physically able to participate, and you will consult a physician if you have concerns.

You will stop activity and notify us immediately if you experience pain, dizziness, shortness of breath, or other concerning symptoms.

We are not medical providers and do not provide medical advice, diagnosis, or treatment.

13) Release of Liability (To the Maximum Extent Permitted by Law)

To the maximum extent allowed by Indiana law, you agree to release and hold harmless Executive Tennis, its coaches, contractors, and representatives from claims arising from participation in sessions or related activities, except where caused by our gross negligence or willful misconduct.

Note: Some clients also sign a separate waiver/release. If presented, that waiver is incorporated into these Terms.

14) Photography, Video, and Testimonials

With your permission, we may take photos or short videos for coaching review and/or marketing. You can opt out at any time by letting us know.

If you provide a testimonial, you grant us permission to use it (with your first name/initial and general location unless you request anonymity).

15) Intellectual Property

All content on our website and materials we provide (drills, plans, videos, branding, text) are owned by Executive Tennis or licensed to us and may not be copied, redistributed, or sold without written permission.

16) Website Use

You agree not to:

Attempt to disrupt or hack the website

Scrape or copy content at scale

Use the site for unlawful purposes
